Transportation and Infrastructure Committee Chairman Sam Graves and Highways and Transit Subcommittee Chairman Rick Crawford have spoken out following a recent court ruling on the FHWA's GHG emissions performance measure rule.
Graves and Crawford commended the U.S. District Court for the Northern District of Texas for its decision, stating, "This was a clear case of blatant overreach by the Biden Administration from the beginning...We appreciate the ruling and remain committed to ensuring the Administration does not exceed its authority."
The FHWA had imposed a GHG emissions performance measure on state departments of transportation and metropolitan planning organizations without the necessary authority from Congress. In response, House and Senate transportation leaders introduced a joint resolution to nullify the FHWA rule and express Congress' objection to the federal overreach.
Chairman Crawford has been leading the effort in the House, supported by Chairman Graves, while in the Senate, the initiative has been led by Senate Transportation and Infrastructure Subcommittee Ranking Member Kevin Cramer and Senate Environment and Public Works Committee Ranking Member Shelley Moore Capito.
